National Takeaway Awards 2020 Terms & Conditions

Information on how to enter the Promotion forms part of these Terms and Conditions. Entries not made in accordance with these terms and conditions will be disqualified.

Section 1: Promotion


1.1.

Restaurant Promotion: 

Restaurants who are nominated by the public in accordance with these Terms and Conditions will be eligible to go into the running to win the Major prize of the National Takeaway Awards as Best Takeaway in Ireland. As part of the prize they will receive a tailored media package to the value of €20,000 promoting them as the Best Takeaway Ireland winner. These Terms and Conditions only apply to the Just Eat National Takeaway Awards. All other awards as part of this series will be awarded to restaurants in the Republic of Ireland at the discretion of Just Eat, based on the total number of votes per category in the Phase 2 (shortlist voting) window. 

Consumer Promotion: 

Members of the public who nominate or vote for their favourite local restaurant in the National Takeaway Awards with these Terms and Conditions will be eligible to go into the running to win free takeaway for a year from Just Eat. As part of the prize they will receive Just Eat account credit to the value of €1,000. These Terms and Conditions only apply to the Just Eat National Takeaway Awards. Each person is entitled to one entry in the draw to win free takeaway for a year following a nomination or vote of their favourite local restaurant. Multiple nominations/votes will only be awarded one entry in the draw for the prize. 

These Terms and Conditions of Entry will be published on the Just Eat website (www.just-eat.ie/) and will be accessible by the Competition Website (nationaltakeawayawards.just-eat.ie) in English. 


1.2.Promoter: Just Eat Ireland, Suite 1, 1st Floor, Nutley Building, Merrion Rd, Dublin 4 (“Just Eat”).


1.3.Promotion Period: The Promotion will commence 8.00am on Monday 2nd November 2020 GMT and will close at 9.00am on Friday 27th November 2020 GMT. Phase One (Nomination voting) will commence at 8.00am on Monday 2nd November 2020 and close at midnight on Sunday 15th November 2020. Phase Two (Shortlist voting) will commence at 9.00am on Wednesday 18th November 2020 and will close at midnight on Wednesday 25th November 2020, following which Prize Winners will be announced on Friday 27th November 2020.

Section 2: Eligibility


2.1.Eligibility: 

a. Restaurants: To be eligible to enter the Promotion, the entrant must be an active restaurant offering a takeaway service in the Republic of Ireland.

b. Consumers: To be eligible to enter the Promotion, the entrant must be over 18 years of age and a resident in the Republic of Ireland.


2.2.Further, any missing or incorrect information or contact details provided on the entry form, or any subsequent cancellation of an entry before the conclusion of the promotion, will render that entry invalid.

Section 3: Entry to the Promotion


3.1.

Restaurants

To enter, restaurants must, during Phase One of the Promotion Period be voted for by the public on the competition website atnationaltakeawayawards.just-eat.ie, and finish as one of the top five most voted restaurants in the respective categories . 

When an eligible entrant is selected as one of the top five most voted restaurants within Phase One of the Promotional Period as noted in Clause 1.3, the entrant will be approved by The Promoter and loaded to the Competition Website as a Shortlist Nominee for their respective categories at the close of the Promotional Period. The Best Takeaway Ireland category will have twenty five entries, as this is representative of all regional categories.


At the conclusion of Phase One of the Promotional Period, all valid nominees will be displayed on the Competition Website, with Restaurant Name, Cuisine Type & Location.

Restaurants in the Republic of Ireland will be eligible to make the shortlist for multiple categories based on the final nominations votes from the public. Entries will be validated by The Promoter prior to making a category shortlist. 

Restaurants are strictly prohibited from using vote exchange mechanisms in order to influence the outcome of the Promotion. Any entrant found to be using vote exchange mechanisms will be disqualified.

This is a competition determined by nomination and shortlist voting tallies and this will determine the entrants and winners during Phase One & Two of the promotion. The promoter’s decision will be final and no correspondence will be entered into. 

Consumers

To enter, members of the public must nominate or vote for a restaurant in the Republic of Ireland in either Phase One or Phase two of the Promotion Period on the competition website atnationaltakeawayawards.just-eat.ie, complete all fields in the nomination or voting form & accept all terms & conditions. 

Members of the public who nominate or vote for a restaurant in Phase One or Two of the Promotional Period as noted in Clause 1.3, will be approved by The Promoter and entered into a draw to win free takeaway for a year.


Section 4: Winner Selection


4.1. Winner Selection - Restaurants: 


During Phase Two of the Promotional Period, members of the public will be invited to vote for their favourite entries nominated in any of the 28 categories. Individuals will be validated using Facebook or Google login. Voting can only be done via the Competition Website, by members of the public clicking the ‘Vote’ Button on an individual restaurant, either displayed on the map or by searching through the award categories. At the conclusion of the Promotion, the top entry with the most votes in any given category will win that category award.

4.2. Winner Selection - Consumer:


At the conclusion of the National Takeaway Awards, the draw for this prize will take place and an eligible winner will be picked at random. Entries will be validated by The Promoter prior to making contact with the winner. The winner of the competition will have 30 days to respond to correspondence from Just Eat Ireland and claim their prize.



4.3. Prize Winners: The Prizes described below in Section 5 will be awarded to the winners selected as described in Section 4.


Section 5: Prizes


5.1. Prize Components: The prizes are as follows:


  1. Just Eat National Takeaway Awards Consumer Competition Winner 2020: Takeaway for a year on Just Eat (€1,000 value account credit).


  1. Just Eat National Takeaway Awards Restaurant Winners 2020:

  1. All Just Eat National Takeaway Award 2020 Winners will receive a Just Eat National Takeaway Awards trophy, a Just Eat National Takeaway Awards winner sticker and Just Eat National Takeaway Awards digital assets that can be used across all communication.

  2. The overall winner of the Just Eat National Takeaway Awards 2020, i.e. winner of ‘Best Takeaway Ireland’ category will receive a media support package worth €20,000 with Just Eat in 2021.




5.2.Prize Conditions: The Prizes are subject to the following conditions:


  1. No exchange of Prize: Prizes will be supplied as described in these Terms and Conditions of Entry. The Prize can be transferred to another person or entity at the absolute discretion of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, the Prize Winner cannot take any component of the Prize and it does not wish to transfer the Prize, then the Prize will be forfeited;

  2. Consent: the Winners consent to be featured in any promotional activity relating to the Winner announcement, including publication on the Promotion website.

  3. If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu.

  4. In the event that there are no valid nominations or no voting in one or multiple categories, then there will be no prize awarded in the relevant category.


Section 6: Prize Winners

6.1. Restaurants


  1. Contact: The Promoter will contact each of the Prize Winners in writing and via phone within seven (7) business days of the conclusion of the Promotion Period. The names of the Restaurant Prize Winners will also be published on the Promoter’s website from Friday, 27 November 2020.

  1. Winner Publicity: In accepting a Prize, the Prize Winner agrees to participate in any publicity arrangements made by or on the behalf of the Promoter in relation to the Promotion. The Prize Winner further acknowledges that the Promoter reserves the right to publicise their restaurant name, address and photographs without any payment being made to them in respect of this Promotion.

6.2.Consumer

  1. Contact: The Promoter will contact the Prize Winner via email or phone on Friday 27th November 2020. The names of the Consumer Prize Winner will also be published on the Promoter’s website.


  1. Winner Publicity: In accepting a Prize, the Prize Winner agrees to participate in any publicity arrangements made by or on the behalf of the Promoter in relation to the Promotion. The Prize Winner further acknowledges that the Promoter reserves the right to publicise their restaurant name, address and photographs without any payment being made to them in respect of this Promotion.


Section 7: General Conditions


7.1.Lost, Delayed Communication: The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication.


7.2.Release: To the fullest extent permissible by law, each entrant in the Promotion including without limitation the Prize Winners, releases the Promoter from any claim, loss, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by such entrant in connection with the Prize or their participation in the Promotion. The Promoter, its related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect, consequential and economic loss) suffered or sustained in connection with this Promotion, the promotion of this Promotion, or the use of any Prize, except for any liability which cannot be excluded by law. Further, to the fullest extent permitted by law, the Promoter excludes liability for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or any website, or any unauthorised intervention, or any combination thereof, including any non-delivery or corruption of entries to the Promoter, injury or damage to participants' or any other person's computer related to or resulting from participation in or downloading any materials in this Promotion. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.


7.3.Force Majeure: Subject to applicable law, the Promoter will not be responsible for any act, omission, failure or delay by the Promoter that is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts, which are not reasonably within the control of the Promoter.


7.4.Disputes: In the event of a dispute, the decision of the Promoter is final and binding and no correspondence will be entered into.

7.5.Just Eat reserves the right to withdraw the competition at any time without prior written notice and/or to alter or amend these terms and conditions at any time.


7.5.Privacy Notice: During the course of the Promotion, the Promoter may collect personal information in relation to entrants and their representatives. This may include, but is not limited to, the names, email addresses, telephone numbers and other details provided by the entrant on the registration form. 

7.6.These terms and conditions shall be governed by the laws of Ireland and subject to the exclusive jurisdiction of the Irish courts.
